Transition of Statements to Education, Health and Care Plans (EHCP)

The transition guidance for Local Authorities states that – ‘By 1 April 2018, Local Authorities must have transferred all children and young people with statements of SEN to the new SEN and disability system who meet the criteria for an EHC plan. Local Authorities must conduct a Transfer Review – that is an EHC needs assessment in accordance with The Special Educational Needs and Disability Regulations 2014’

Many Local Authorities, including Norfolk are struggling to meet this deadline due to the high numbers of children with statements. It has just been confirmed by the Minister of State for Children and Families; Robert Goodwill MP, that this deadline will not be changing. He stated that any Statements that have not had a complete transfer will remain in force from 1st April 2018. If your child or young person has got a Statement of SEN, you might want to ask your EHCP co-ordinator when their transfer review /EHC needs assessment is likely to take place.
