Education, Health and Care Plan (EHCP)
Is your child moving from nursery to primary school, primary to secondary school in September 2017? Do they have an Education, Health and Care Plan (EHCP) or a Statement?
If so, by February 15th you will receive a final amendment notice from the Local Authority naming the new school. If you are not happy with the school named on the final amendment notice you have the right to appeal. You can appeal the placement and/or the wording in the statement/EHC plan regarding their needs and/or provision. When you receive the amendment notice you should also receive a copy of the EHC plan /statement. If you do not receive this then you can request a copy from your Education Health and Care Plan (EHCP) co-ordinator.
Remember the EHC plan/statement should be specific (clear) and quantified (how much /type of support your child will have). If you are unhappy with the EHC plan/statement, speak with your EHCP Co-ordinator to talk over the changes you would like to make, as you may find they agree with your changes.
If you are still in disagreement then you can appeal to the SEND Tribunal. If you have an EHC plan and you are appealing sections B (educational needs), F (educational provision) as well as section I (placement) then you will have to consider mediation first before you appeal. You will then be issued with a mediation certificate. You then have to lodge your appeal within two months of the amendment notice or one month of the mediation certificate, whichever is the later date. (If you have a statement then you do not need to consider mediation and therefore you need to lodge your appeal within two months from the amendment notice).
A young person moving to further education will receive their amendment notice by 31st March 2017 and again they would have the right to appeal if they are not happy with their EHC plan/placement as above.

We are also holding a tribunal (appeal) workshop on 16th March 2017 at Norwich PDC for parents and young people who are considering whether to appeal or not. Cancellation of the Spring IPS Training
Unfortunately we had to cancel the Spring IPS training which was due to commence the beginning of February due to staffing issues. We are hopeful that another will run in the Autumn term. If you had expressed an interest or wish to find out more please contact us.
